BackgroundRobust ethics consultation services cannot be sustained by all hospitals; consultative service from a high-volume center via teleconferencing is an attractive alternative. This pilot study was conceived to explore the feasibility and understand the practical implications of offering such a service.MethodsHigh-definition videoconferencing was used to provide real-time interaction between the rounding clinicians and a remote clinical ethicist. Data collection included: (1) evaluation of the hardware and software required for teleconferencing, and (2) comparison of ethics trigger counts between the remote and (...) on-site ethicist during rounds.ResultsIssues with audio represented the majority of technical problems. Once technical difficulties were addressed, the onsite ethicist’s count of “triggers” was not statistically different from the count of the remote ethicist.ConclusionRemote clinical ethics rounding is feasible when the equipment is optimized. Remote ethicists can identify similar numbers of “triggers” for possible ethical issues when compared to on-site ethicist numbers. (shrink)

Nursing Inquiry 2010; 17: 373–384 Getting on Target with Community Health Advisors (GOTCHA): an innovative stroke prevention projectHealth disparities along with insufficient numbers of healthcare providers and resources have created a need for effective and efficient grassroots approaches to improve community health. Community‐based participatory research (CBPR), more specifically the utilization of community health advisors (CHAs), is one such strategy. The Getting on Target with Community Health Advisors (...) (GOTCHA) project convened an interdisciplinary team to answer the call from 10 counties in the rural Mississippi Delta area of ‘The Stroke Belt’ to meet the region’s identified health needs, and to impact the health of a disparaged state. This article explores this CBPR project including the community involvement strategies, innovative CHA training curriculum, evaluation plan, and implications to healthcare professionals, particularly nurses. But the similarity between the two apparatus, the nervous system and the electric telegraph, has a much (...) deeper foundation. It is more than similarity; it is a kinship between the two, an agreement not merely of the effects, but also perhaps of the causes. 1In 1851 the telegraph and the nervous system appeared to be doing the same things and for the same reasons. Their common purpose was the transmission of information, and they both conveyed this information as alterations in electrical signals. By calling the nervous system a "model" for the telegraph, DuBois-Reymond suggested that organic communications systems offered solutions to problems encountered by technological ones.In the same decade, however, Claude Bernard remained skeptical about the epistemological value of metaphor. From the classical notion of nervous fluid to the more recent ones of animal spirits and animal electricity, he pointed out, people's "knowledge" of the nervous system had consisted largely of a series of comparisons, "the expression of a way of seeing meant to explain the facts." 2 Priding himself on his empiricism, Bernard mistrusted analogy as a means of constructing knowledge. Does one know more or less about something, if one asserts that it is like something else? What exactly is the relationship between metaphor and knowledge? [End Page 105]Many scientific investigators have shared Bernard's concern that claims of likeness will change their perceptions of physiological systems, but for the same reason some scholars of language are more optimistic about the epistemological possibilities of metaphor. George Lakoff and Mark Johnson assert that the role of metaphor in scientific thinking provides one of the best illustrations of how metaphors reflect and influence what we see and do. "Formal scientific theories are attempts to consistently extend a set of ontological and structural metaphors," they argue. 3 This "extension," though, is just what worried Bernard. Metaphors provoke and give birth to new images. By establishing and reinforcing connections, they encourage us to see in new ways. While Bernard is correct that assertions of likeness alter the way we see, Lakoff and Johnson are equally correct in claiming that "much of cultural change arises from the introduction of new metaphorical concepts and the loss of old ones." 4 Alterations in the way we see can be extremely productive.One of the most intriguing cases through which to study the epistemological role of metaphor is that of comparisons between physiological and technological communications systems. Throughout the nineteenth century scientists' electrophysiological understanding of the nervous system closely paralleled technological knowledge that allowed for the construction of telegraph networks. Timothy Lenoir has demonstrated that Hermann Helmholtz and Emil DuBois-Reymond, the nineteenth-century scientists who made some of the greatest contributions to neurophysiology, worked closely with communications engineers like Werner Siemens. By developing models that reflected the apparatus they had adapted from physics and media technology, Helmholtz, and DuBois-Reymond changed people's understanding of the way nerves transmitted impulses. I agree with Lenoir that these comparisons between organic and technological systems were not mere devices for popularization but became incorporated into the scientists' own vision and understanding of the nervous system. 5 When one reads the proposals of nineteenth-century engineers, one begins to suspect that communication in the body and in society can only be understood in terms of each other. Recent revisions in child support and paternity establishment legislation enacted under the 1996 welfare reform act, the Personal Responsibility and Work Opportunity Reconciliation Act, significantly alter the American welfare state's relationship to men's fathering. Through a critical review of prior research and social service literature, the authors argue that PRWORA actively constructs fatherhood not only through state policies that maintain males as “breadwinners” but also through state-sponsored social service programs that seek to influence men's identities as fathers. In order to move towards an Ethic of Accounting, one must start by defining the function and role of the accountant. This in turn depends to a great extent on the identity of the client or whatever party the Accountant owes his loyal agency to. The issue is one of cardinal importance, and it is perceived as such by the accountants themselves. Loeb for instance says that the client-identity issue is overriding importance now, and will become even more crucial in (...) the immediate years ahead. The question of what constitutes ethical behaviour on the part of the accountant will depend then upon the relation within which such ethical behaviour will have to be deployed.The main question raised in this paper will therefore be, is the accountant primarily engaged by one client (whether an individual or a corporation) to act as their agent, deal with their problems by loyally advancing their interests to the best of his professional competence, although within the limits imposed by law and morality? Global crises such as the climate crisis require fast concerted action, but individual and structural barriers prevent a socio-ecological transformation in crucial areas such as the mobility sector. An identification with people all over the world and an openness toward less consumption may represent psychological drivers of a socio-ecological transformation. We examined the compatibility of both concepts as well as their relation to people’s support of a decarbonised mobility system and their flight mobility behaviour – a CO2-intensive behaviour that may (...) be particularly difficult to refrain from for globally identified people, but less so for sufficiency-oriented people. In an online study conducted in Germany, we found that global identity and sufficiency orientation were positively related. Both were negatively related to past flight-related CO2 emissions and positively related to refraining from flying and the support of decarbonised mobility policies. Accounting for both showed that sufficiency orientation in particular was related to fewer flight-related CO2 emissions and refraining from flying. Furthermore, we examined people’s travel experiences. While global identity was unrelated to the frequency and duration of international travelling, it was positively related to the frequency and quality of contact with local people met on journeys. An experimental variation of whether participants first answered questions on global identity or on travel experiences revealed that remembering past international travelling led to higher reported levels of global identity. Taken together, global identity seems to profit from in-depth international contact with people, but can be decoupled from resource-intensive travel behaviour. Globally identified and sufficiency-oriented people may support a socio-ecological transformation. Our results indicate a compatibility of global identity and sufficiency orientation. Experimental and longitudinal research should examine causal links to foster our understanding of the conditions under which both can be strengthened. (shrink)

Whether sought for medical treatment, disease prediction studies, cultural studies, or the general study of human origins, human genetic information is now viewed as crucial for scientific research and general attempts at human understanding.With the importance of genetic information have come bitter battles over its control. The demonstrated power of human genetic information has moved the issue of its “ownership” from the realm of musty academic musings to (...) protracted political and legal battles among “source” individuals, researchers, commercial concerns, government agencies, and others. Whether collected through targeted scientific studies, “discarded” biological tissue, initial charitable bequest, or other means, genetic information and the biological materials in which it is contained have become the subject of protracted legal battles for control and intense social and ethical controversy. This article presents a conceptual framework within feminist therapy theory for viewing overt and covert racist behaviors as forms of unethical action. Using the personal as theoretical and political, the author traces her process of having her consciousness raised regarding the issue of racism in psychotherapy. Racism is then conceptualized as an ethics problem in terms of lack of mutuality and respect, violation of boundaries, and unethical imbalance of power in the therapy relationship. The concept of antiracism, a proactive stance (...) to address overt and covert racism in therapy, is presented as a strategy for moving toward more ethical therapy practice. (shrink)

In this commentary I discuss the shared theme found in articles by Hoult, Calof, Cheit, Freyd, and Salter (this issue) of the prices of resisting attempts to engender silence when the topic is sexual abuse of children. The parallels between silencing tactics of sexual abusers of children and those used by the false memory movement against its critics are analyzed. Questions are raised about the ethical implications of such silencing strategies.

The past thirty years have seen substantive debate on the nature of Robert Boyle’s self-described “Mechanical” or “Corpuscularian” philosophy, its treatment of kinds and qualities, its relation to his experimental studies, its relation to other sixteenth- and seventeenth-century matter theories, and its role in the development of chemistry. How can citizens construct the political authority under which they will live? I argue that Thomas Hobbes’s Leviathan (1651) answers this question concerning the constitutive power of political and normative agency by employing four dimensions of mimesis from the Greek and Roman traditions. And I argue that mimesis accounts for the know-how, or power/knowledge, the general ‘man’ draws upon in constructing the commonwealth. Hobbes revalues poetic mimesis through his stylistic decisions, including the invitation to the reader to read ‘himself’ in (...) the portrait of the general man depicted in the text. Hobbes aims for Leviathan to change the ethical dispositions of its readers, turning them from bad to good men as they witness the general man undergoing this ethical transformation in the transition from the state of nature to the civil state. He emphasizes the anthropological dimension of mimesis to explain political disorder since he argues that men assess the honor others attribute them by observing signs and gestures in others’ behavior. Hobbes employs the linguistic dimension of mimesis to describe how men acting as agents can build a normative consensus out of the state of nature. This article positions mimesis as a key term for understanding the intersection between aesthetics and politics before the term ‘aesthetics’ came into parlance. (shrink)

Legal scholars and philosophers have long been engaged in what has been called 'the pursuit of the holy grail of property' - the secret of the internal structure of property in law. Attempts to capture the idea of property have encountered two fundamental problems. First, it has been notoriously difficult to advance beyond the observation that property involves 'ownership' of 'things', with the incidents of ownership and the list of things owned an essentially descriptive task. Second, it is difficult to (...) explain the wildly inconsistent power that property rights - even when identified - seem to enjoy.In this book, Professor Underkuffler advances our understanding of what property is, as an idea, and the power that claimed property rights should have against competing public interests. There is, she argues, a deeper analytical structure of the idea of property that we can uncover, and - as a result of that discovery - deeper reasons that we can find for property's variable power. It is not a random or unprincipled event that property generally protects in cases involving land titles or patent claims, and fails to protect in cases involving environmental regulation or redistributive taxation. She argues that these results are driven - indeed, predetermined - by the nature of property, as an idea, and the conflicts of that idea with competing public interests. The implications of this book are far-reaching. It explains and justifies - on new grounds - why some property claims are traditionally powerful in law, and others not. It suggests how property rights in controversial or emerging areas should be treated, such as those involving the body as property, personal information as property, cultural property, and state redistributive claims. Finally, it establishes why the protection of property is, in fact, necessarily different from freedom of speech, freedom of religion, due process of law, and other rights - necessitating its different treatment, and lesser protection, as a constitutional right. Generally, in liberal democratic systems, it is assumed that government should forbear from interference with existing individual property entitlements. It is assumed that existing individual property entitlements should be respected, with government reluctant to interfere. Despite the ubiquity of this assumption, the theoretical underpinning for it is not obvious. A sovereign must respond to the needs of all of the members of the greater community for which it speaks. In view of this obligation, irrevocably assigning property rights to some, and (...) not to others, is an inherently troublesome proposition. In this Article, the reasons for this state of affairs are examined. The conclusion is reached that conventional theories advanced by courts and commentators for government forbearance — such as protecting individual reliance interests, or advancing other independent policies — fail to explain the forbearance phenomenon. A more convincing reason can be found in a public fiduciary theory of government. However, recognition of this reveals that the property/sovereignty relationship is far more complex than a simple forbearance model would dictate. The burden of this piece is to draw together into a coherent whole the somewhat diverse strands of Israel Scheffler's thought on the philosophy of religion. Extrapolating from personal discussions with Professor Scheffler, various of his books, articles, and other unpublished materials authored and kindly provided by him, I contend that he adumbrates a post-empiricist rendering of religious belief which masterfully avoids some philosophical problems, while unwittingly giving rise to others. Committed to the view that the methodology of science – (...) in one or other of its more acceptable guises – provides the most reliable measure of the content and structure of reality. Scheffler is bound conceptually to redefine Jewish belief in such a way that the traditional conflict between religion and science never emerges. Consistent with this end, he is concerned to divest traditional Judaism of its metaphysical garb, so that what remains are simply the matters of living to which religion ought properly on his view address itself. The Bible is thus reconceptualized as a piece of rich literature, of no real difference in logical kind to any other piece of rich literature, except that it defines uniquely, along with the Torah and other relevant Jewish literature, the history of the particular community whose perception of human values and meaningfulness forms the core of what it is to be Jewish. This article analyzes two poetic units within a much longer composition composed by Yannai for recitation on Yom Kippur. Specifically, it offers readings of Unit 8, which prefaces the third blessing of the Amidah, and Unit 15, which concludes the work. Both units dwell on the physical experience of Yom Kippur and the ways in which ritual affects the body, permitting us to consider the role of “kinesthetic theology” – i.e., how physical expression and embodied experiences not only reflect but (...) shape belief – in the composition. We present a rendering of some common grammatical formalisms in terms of evolving algebras. Though our main concern in this paper is on constraint-based formalisms, we also discuss the more basic case of context-free grammars. Our aim throughout is to highlight the use of evolving algebras as a specification tool to obtain grammar formalisms.

DNA topoisomerases are enzymes that can modify, and may regulate, the topological state of DNA through concerted breaking and rejoining of the DNA strands. They have been believed to be directly involved in DNA excision repair, and perhaps to be required for the control of repair as well. The vicissitudes of this hypothesis provide a noteworthy example of the dangers of interpreting cellular phenomena without genetic information and vice versa.

Some philosophers argue that the principles of human reasoning are impeccable, and that mistakes are no more than momentary lapses in “information processing”. This article makes a case to the contrary. It shows that human reasoners commit systematic fallacies. The theory of mental models predicts these errors. It postulates that individuals construct mental models of the possibilities to which the premises of an inference refer. But, their models usually represent what is true in a possibility, not what is false. This (...) procedure reduces the load on working memory, and for the most part it yields valid inferences. However, as a computer program implementing the theory revealed, it leads to fallacious conclusions for certain inferences—those for which it is crucial to represent what is false in a possibility. Experiments demonstrate the variety of these fallacies and contrast them with control problems, which reasoners tend to get right. The fallacies can be compelling illusions, and they occur in reasoning based on sentential connectives such as “if” and “or”, quantifiers such as “all the artists” and “some of the artists”, on deontic relations such as “permitted” and “obligated”, and causal relations such as “causes” and “allows”. After we have reviewed the principal results, we consider the potential for alternative accounts to explain these illusory inferences. And we show how the illusions illuminate the nature of human rationality. (shrink)

Isocrates' Antidosis ("Defense against the Exchange") and Aristotle's Protrepticus ("Exhortation to Philosophy") were recovered from oblivion in the late nineteenth century. In this article we demonstrate that the two texts happen to be directly related.
